2. Purpose
These Terms and Conditions of Sale apply without restriction or reservation to all online sales offered by SHARKZ on the site Vibram Five Fingers (the "Site").
The Site is an e-commerce platform allowing internet users (the "Buyers") to purchase various products, notably shoes and accessories, offered for sale on the Site (the "Products").
These Terms and Conditions of Sale aim to define the terms and conditions of online sale and delivery of Products, as well as the rights and obligations of the parties in this context.
They are accessible and printable at any time via a link available on the Site.
The applicable version of the Terms and Conditions of Sale is the one available online on the date of the Buyer's order.
3. Legal Capacity and Acceptance of Terms
The provisions relating to legal capacity and acceptance of the Terms and Conditions of Sale set out herein apply to any order placed on the Site.
Validation of the order implies full and complete acceptance of these Terms and Conditions of Sale by the Buyer.
4. Placing and Confirming an Order
The Buyer selects the Product(s) of their choice and adds them to their cart.
Before final validation of their order, the Buyer can check their cart and correct any errors.
The Buyer must provide all information necessary for billing and delivery of their order and guarantees the accuracy of the information provided.
At the end of the order, a confirmation is sent to the Buyer by email.
5. Product Characteristics
Before placing any order and in accordance with applicable provisions of the French Consumer Code, the Buyer can review the essential characteristics of each Product on the Site.
Products are offered subject to available stock.
Photographs and descriptions are presented as accurately as possible. However, some differences, particularly in color, may appear depending on screens or shooting conditions.
6. Price and Payment Terms
Product prices are shown in euros, all taxes included.
Any delivery fees are indicated to the Buyer before final validation of their order.
The applicable price is the one displayed on the Site at the time of the order.
Payment is due upon ordering and can be made using the payment methods offered on the Site.
SHARKZ reserves the right to suspend or cancel any order in the event of a payment incident, fraud, or attempted fraud.
Products remain the property of SHARKZ until full payment of their price.
7. Delivery
Products are delivered to the address provided by the Buyer when placing their order.
Available delivery methods, fees, and estimated timeframes are communicated to the Buyer before final validation of their order.
In the event of a delivery delay, the Buyer benefits from the rights provided under applicable provisions of the French Consumer Code.
8. Right of Withdrawal and Refund
In accordance with applicable provisions of the French Consumer Code, the consumer Buyer has a period of 30 days from receipt of their order to exercise their right of withdrawal, without having to justify their decision.
Where several Products from the same order are delivered separately, the period runs from receipt of the last Product.
To exercise the right of withdrawal, the Buyer must send a clear request to:

After communicating their decision to withdraw, the Buyer has 30 days to return the Products in accordance with the return instructions provided by customer service.
Unless otherwise applicable, direct return costs remain the responsibility of the Buyer.
Returned Products must be in a condition suitable for resale. The Buyer's liability may be engaged in the event of depreciation resulting from handling other than that necessary to establish the nature, characteristics, and proper functioning of the Product.
In the event of valid withdrawal, SHARKZ will refund the amounts due within a maximum period of 30 days from the date on which it is informed of the decision to withdraw.
SHARKZ may delay the refund until the Products are recovered or until the Buyer provides proof of their shipment, whichever occurs first.
The refund is made, unless otherwise agreed, using the same payment method used for the order.
9. Legal Warranties
The Buyer benefits from the legal guarantee of conformity as well as the guarantee against hidden defects, in accordance with applicable French legal provisions.
In the event of a defective, damaged, or non-conforming Product, the Buyer can contact:
indicating their order number, the nature of the problem encountered, and, where useful, attaching photographs.
The consumer's rights under the legal warranties are not affected by any commercial warranty offered on the Site.
10. Buyer's Obligations
The Buyer is responsible for the accuracy of the information provided when placing their order.
It is also up to the Buyer to verify that the Products meet their needs before purchasing them.
11. Liability
SHARKZ cannot be held liable for any delay or non-performance resulting from a force majeure event within the meaning of Article 1218 of the French Civil Code.
These provisions may not have the effect of limiting or excluding the mandatory rights enjoyed by the consumer under applicable law.
12. Intellectual Property
The content on the Site, including text, photographs, illustrations, graphic elements, databases, and other protected elements, is subject to the intellectual property rights of their respective owners.
Any unauthorized reproduction, representation, extraction, or use of protected content is prohibited.
13. Personal Data
SHARKZ undertakes to process personal data in accordance with applicable regulations, including the General Data Protection Regulation (GDPR) 2016/679 and French legislation on the protection of personal data.

14. Changes to the Terms and Conditions of Sale
SHARKZ may modify these Terms and Conditions of Sale.
The Terms and Conditions of Sale applicable to an order are those in effect on the date the order is placed.
15. Language
These Terms and Conditions of Sale are drafted in French.
In case of translation, the French version prevails in the event of any difficulty of interpretation.
16. Opt-Out of Telephone Solicitation
Where the legal conditions are met, the consumer may register free of charge on the Bloctel telephone solicitation opt-out list.
17. Consumer Mediation
In accordance with the provisions of the French Consumer Code relating to consumer dispute mediation, the consumer has the right to use, free of charge, a consumer mediator for the amicable resolution of a dispute with SHARKZ.

18. Applicable Law
These Terms and Conditions of Sale are governed by French law.
Where the Buyer is a consumer residing in another European Union member state, they retain the benefit of the mandatory consumer protection provisions applicable in their country of residence.
